Conservatives and Republicans today suffered their most crushing legislative defeat since the 1960s.

It’s hard to exaggerate the magnitude of the disaster. Conservatives may cheer themselves that they’ll compensate for today’s expected vote with a big win in the November 2010 elections. But:

(1) It’s a good bet that conservatives are over-optimistic about November – by then the economy will have improved and the immediate goodies in the healthcare bill will be reaching key voting blocs.

(2) So what? Legislative majorities come and go. This healthcare bill is forever. A win in November is very poor compensation for this debacle now.

So far, I think a lot of conservatives will agree with me. Now comes the hard lesson:

A huge part of the blame for today’s disaster attaches to conservatives and Republicans ourselves.

At the beginning of this process we made a strategic decision: unlike, say, Democrats in 2001 when President Bush proposed his first tax cut, we would make no deal with the administration. No negotiations, no compromise, nothing. We were going for all the marbles. This would be Obama’s Waterloo – just as healthcare was Clinton’s in 1994.

Only, the hardliners overlooked a few key facts: Obama was elected with 53% of the vote, not Clinton’s 42%. The liberal block within the Democratic congressional caucus is bigger and stronger than it was in 1993-94. And of course the Democrats also remember their history, and also remember the consequences of their 1994 failure.

This time, when we went for all the marbles, we ended with none.....it’s Waterloo all right: ours.

We’ve always known that America’s reign as the world’s greatest nation would eventually end. But most of us imagined that our downfall, when it came, would be something grand and tragic....

.....The truth is that given the state of American politics, the way the Senate works is no longer consistent with a functioning government. Senators themselves should recognize this fact and push through changes in those rules, including eliminating or at least limiting the filibuster. This is something they could and should do, by majority vote, on the first day of the next Senate session.

Don’t hold your breath. As it is, Democrats don’t even seem able to score political points by highlighting their opponents’ obstructionism.

It should be a simple message (and it should have been the central message in Massachusetts): a vote for a Republican, no matter what you think of him as a person, is a vote for paralysis....

Kennedy assassination and the Martin Luther King, Jr. assassination. The Committee investigated until 1978, and in 1979 issued its final report, concluding that President John F. Kennedy was probably assassinated by a conspiracy involving the mob, and potentially the CIA.The House Select Committee on Assassinations undertook reinvestigations of the murders of John F. Kennedy and Martin Luther King, Jr. In 1979, a single Report and twelve volumes of appendices on each assassination were published by the Congress. In the JFK case, the HSCA found that there was a "probable conspiracy," though it was unable to determine the nature of that conspiracy or its other participants (besides Oswald).....

What is interesting is that upon his return he got more money from the State Department to buy a house and work with an ex FBI Chief and CIA officials in training anti-Castro Cubans for an invasion.In Louisiana, where he was working, the CIA was involved in Operation Mongoose, Where Oswald worked under CIA Agent David Ferrie, who killed himself before testifying in a trial on the Assassination as well.... Oswald's tax returns are still classified top secret to this day. Why? Perhaps he was still getting $$ from the United States, which places him on the payroll.

Senate Passes Landmark Health Care Bill

This morning, after a year-long fight with Republicans, and a weeks-long debate, which ultimately pitted Democrat against Democrat, and liberal against liberal, the Senate passed a historic bill calling for major reforms of the U.S. health care system by a vote of 60-39. Presiding over the Senate, in a rare appearance, was Vice President Joe Biden. As Senate chair, the Vice President can serve as the tie-breaking vote in the event of a 50-50 deadlock. But tonight's victory for Democrats was never in doubt....

Police Tapped Sprint Customer GPS Data 8 Million Times In A Year

Under a new system set up by Sprint, law enforcement agencies have gotten GPS data from the company about its wireless customers 8 million times in about a year, raising a host of questions about consumer privacy, transparency, and oversight of how police obtain location data. What this means -- and what many wireless customers no doubt do not realize -- is that with a few keystrokes, police can determine in real time the location of a cell phone user through automated systems set up by the phone companies.

And while a Sprint spokesman told us customers can shield themselves from surveillance by simply switching off the GPS function of their phones, one expert told TPM that the company and other carriers almost certainly have the power to remotely switch the function back on....

Yahoo: Our spying policy would ’shock’ customers

A little-noticed letter from Yahoo! to the US Marshals Service offers troubling insight into the surveillance policies of one of the Internet's largest email providers.

In response to a Freedom of Information Act request seeking details of Yahoo's! policies allowing the Justice Department to request wiretaps of its users and the amount they charge US taxpayers per wiretap -- the search engine leviathan declared in a 12-page letter that they couldn't provide information on their approach because their pricing scheme would "shock" customers. The news was first reported by Kim Zetter at Wired....

Release of secret reports delayed

President Obama will maintain a lid of secrecy on millions of pages of military and intelligence documents that were scheduled to be declassified by the end of the year, according to administration officials.

The missed deadline spells trouble for the White House’s promises to introduce an era of government openness, say advocates, who believe that releasing historical information enforces a key check on government behavior. They cite as an example the abuses by the Central Intelligence Agency during the Cold War, including domestic spying and assassinations of foreign officials, that were publicly outlined in a set of agency documents known as the “family jewels.’’

The documents in question - all more than 25 years old - were scheduled to be declassified on Dec. 31 under an order originally signed by President Bill Clinton and amended by President George W. Bush.

Patriot Act Renewal Moving Forward

Renewal of two controversial Patriot Act provisions set to expire at the end of the year have been approved by House and Senate Committees over the past month, and appear headed for floor votes in both bodies. President Obama has endorsed extending the provisions.

The two provisions include the “records” rule and the “roving wiretaps” provision. The so-called “records” rule grants federal officials with a court order the power to force private parties such as businesses, hospitals, and libraries to hand over "any tangible thing" they believe has "relevance" to a terrorist investigation.

“Roving wiretaps” allow wiretapping multiple lines of communication without informing FISA (Foreign Intelligence Surveillance Act) courts which specific phone lines or communication media are being targeted.

President Obama has reversed himself on the issue, since he once opposed Patriot Act provisions as a fishing expedition by federal snoops in a December 15, 2005 Senate speech:

If someone wants to know why their own government has decided to go on a fishing expedition through every personal record or private document — through library books they've read and phone calls they've made — this legislation gives people no rights to appeal the need for such a search in a court of law. No judge will hear their plea, no jury will hear their case. This is just plain wrong...

Following Bush-era argument, Obama attorneys push to weaken search protections

Even though a Bush-era request to conduct blanket searches of computer files was rebuked by judges, the Obama administration is now pushing to have the decision reversed, according to court documents filed the week of Thanksgiving.

U.S. Solicitor General Elena Kagan, an Obama appointee, and twenty other government attorneys submitted a brief to the Ninth US Circuit Court of Appeals, making a very extraordinary request.

Federal prosecutors went too far when they seized the drug test results of 104 pro baseball players, according to a 9-2 "en banc" panel decision in August by the 9th US Circuit Court of Appeals. The ruling included guidelines for computer search conduct designed to protect Fourth Amendment privacy rights, in the style of Miranda rights.

Drug-Makers Paying Off Competitors To Keep Cheap Generics Off Market

Republicans and their allies in the business community talk a good game about the virtues of free-market competition. But, as we've seen in the debate over the public option, that stance often goes out the window when corporate profits are at stake.

And now we've got another example -- one of the sleaziest and most blatantly self-serving yet.

Over the last few years, drug-makers have embraced a startlingly simple tactic for fending off competition from generic brands: paying them off. In a nutshell, the company that holds the patent on a profitable drug strikes a deal with the maker of the cheaper generic brand: you hold off on marketing your generic for several years, and in return, we'll give you a share of our profits on the drug.

So common have these deals become lately that they've been given a name: pay-for-delay. The approach -- a textbook anti-competitive tactic -- is worth billions to drug-makers...

The news cycle was pretty slow while I was in Hawaii, the Senate is still making sausage with the Health Care Bill, so no real news on that bill until it gets to the conference committee. Look for the bill to be split in two and be made a "Budget Reconciliation Bill" meaning it will only need 50 votes for passage. The current debate is little more than theater for Television. Bush did the same thing with the Tax Cuts for the wealthy Americans, I expect Obama will do the same with the Health care bill. The Republicans now seem to think the mess in Afghanistan is so bad all business in Congress should stop and deal with Afghanistan. WTF, where were the Republicans the last 8 years when Bush was doing nothing in Afghanistan?

At a recent stop on her "Going Rogue" book tour, Sarah Palin told Canadian comedian Mary Walsh that Canada should get rid of its public health care system.

Walsh is the co-creator and star of This Hour Has 22 Minutes -- a nightly news parody show in the same vein as The Daily Show -- and she arrived in character, as the conservative Marg Delahunty, to the Borders where Palin (the "Alaskan Aphrodite") was signing books.

SPOILERS AHEAD*: It took over a decade, but "Seinfeld"-less fans finally received a new episode. Sort of. This season's "Curb Your Enthusiasm" followed Larry as he put together a reunion in an attempt win back Cheryl, and last night the results were finally unveiled.

For any "Seinfeld" fan, the season has been a dream come true. Not only were the characters reunited, but we finally saw them interact with Larry, the neurotic man who put it all together. Especially hilarious was Larry's ongoing feud with Jason Alexander, who given the character he made famous, can be considered the "Bizarro Larry." The tip at lunch, the borrowed pen, and even last night's competition for Chery's affection - it was all glorious.

Throughout the series, Larry has worn his connection to George as a badge of honor, taking offense when anyone referred to the character as a "yutz" or "schmuck." His pride reached new heights last night as he got the chance to play the character himself when Jason Alexander threatened to quit.....
